1. General
AdvoCare International, LLC (“AdvoCare”) endeavors to maintain the security of your personal information (i.e., information that identifies an individual, such as full name or email address). This privacy policy (“Privacy Policy”) describes how AdvoCare collects, uses, and shares the personal information you may provide on this site, such as when purchasing an AdvoCare product, as well as through related online properties and mobile applications that link to this Privacy Policy. This Privacy Policy also applies to personal information that AdvoCare collects through offline methods, such as when a distributor (“Distributor”) submits a distributorship application to us or when a customer calls our Customer Service team. These interactions with AdvoCare and the provision of our products are collectively referred to as “Services.”
AdvoCare Distributors are independent sellers of AdvoCare products. AdvoCare may use information it receives from Distributors about their customers as set forth in this Privacy Policy. Unless otherwise indicated, this Privacy Policy does not apply to a Distributor's collection or use of information obtained by the Distributor directly from a customer.
Our website is intended solely for users in the United States. If you are located outside of the United States and are accessing our website, your personal information as described in this Privacy Policy will be processed and stored in the United States, and the laws in the United States may not be as protective of personal information as laws in your resident country. If you do not agree with the processing of your personal information in the United States, or you do not otherwise accept our Terms of Use, please discontinue your use of the website.
2. How We Collect Personal Information
From you. This includes personal information when you voluntarily provide it through our website or when you provide it to us through other means. For example, we may collect personal information when you: create an account; sign up for our newsletters; visit our social media pages; enroll in automatic payments; enter a promotion; register with us as a Distributor, a Preferred Customer, or a Registered Retail Customer; use the website to make a purchase; contact us through e-mail, telephone, mail, or other correspondence; or otherwise use our Services.
From devices you use when you interact with us online. This includes information collected through our Services and automatically from devices you use to connect to our Services. For more information about this, please see the “Cookies and Similar Technologies” section below.
From third parties and publicly available sources. This includes, for example, personal information we collect from other sources, including, but not limited to, websites that enable social sharing, social media sites, and third parties.
3. Types of Personal Information We May Collect From You
Depending on how you interact with us, we may collect the following information:
- Contact Information, such as your first and last name, address, telephone number, or e-mail address, your home or shipping location, or other similar identifiers.
- Commercial and Limited Payment Information, such as billing address, transaction information, and purchase history.
- Biographic Information, such as date of birth.
- Account Information, such as a username and password, profile details you choose to provide, and feedback and reviews you may leave our Services.
- Activity Information, such as information we collect when you access and interact with our Services, including browser or device model and settings, operating system, and unique identifiers, clickstream data, cookies and local Storage, browsing history, search history, web-based location, IP address, browser information, and any other Internet usage information our Services may automatically record when you visit. For more information about cookies and similar technologies, please refer to the “Cookies and Similar Technologies” section below.
- Inferences, such as inferences drawn from any of the personal information identified.
- Sensitive Personal Information, such as Social Security Number in cases where Distributors earn commissions for selling products and require tax related documentation.
- Professional Information, for prospective employees, this may include information about your job function and role, title, professional affiliations, employer, and employment history and any other information that may be obtained from third-party background checks and feedback.
- Other Personal Information that you voluntarily choose to submit to us, such as the content provided either in your Distributor application or in your communications with us, including interactions with us online or on the phone, including call recordings.
4. How We Use Your Personal Information
We may use your information for the following reasons, depending on your relationship with us:
- To provide you the Services requested.
- To communicate with you, such as when we respond to your inquiries and send you communications through email or SMS/MMS messages to your text-enabled device, such as push notifications, our newsletter, information regarding our Services, or promotions offered. This may also include when we send you administrative e-mail notifications, such as information about AdvoCare accounts or transactions; security or support and maintenance advisories; and changes to policies.
- To market and provide our Services to you.
- To enable you to participate in surveys and other research efforts.
- To serve you targeted advertising or content.
- To provide, market, and develop our Services, including to maintain our websites, troubleshoot, provide customer and technical support, conduct data analysis, test and research, and better understand the interests of our customers.
- To understand how you interact with our Services and personalize the product experience and content (including advertising and messaging campaigns).
- To maintain the safety, security, and integrity of our Services, for example, by authenticating users and providing account security and fraud detection. We may also use your information to monitor, detect, and prevent fraud and improper or illegal activity.
- To debug our systems, to secure our online services, including our network and websites, and to debug our online services.
- To send you news and/or marketing communications (by email, phone, or text) subject to your marketing preferences and choices, including information about us or third-party offerings we think may be of interest to you.
- To conduct market research and develop quality assurance, including to study, develop, and improve our Services. This may include measuring and analyzing audience traffic, including tracking user interests, trends, and patterns. We may also aggregate, anonymize, and/or de-identify personal information we collect and use it for any purpose, including product development and improvement activities.
- To comply with our policies, legal requirements, and/or to investigate or address claims or disputes relating to your use of the Services. This would include the use of your information to comply with our legal and regulatory obligations, to defend ourselves in litigation and investigations, and to prosecute litigations.
- To enforce contractual and payment obligations, including carrying out and enforcing Distributor agreements.
- To help recognize you as a previous visitor and save and remember your preferences and settings and deliver to you appropriate interest-based content.
- For internal business purposes, including for data analysis, audits, and enhancing our Services. We may also use inferences drawn from personal information to create a profile reflecting your preferences, so we can tailor our Services to you.
- To collect analytics in order to understand how our Services are used and to improve them over time.
- To process and complete transactions, including collecting payment and contact information to process your transactions.
- To validate sales by AdvoCare Distributors and for AdvoCare's compliance purposes. AdvoCare or its authorized third parties may contact individuals directly for these purposes.
5. How We Disclose Personal Information
In order to further AdvoCare's business, depending on your relationship with us and the services provided, we may disclose some of the personal information collected from or about you with any of the following entities for any of the following purposes:
- Advertising Partners. We may provide personal information to third parties, such as advertising partners or other marketing partners who provide services to us.
- Service Providers. We may provide personal information to vendors, payment processors, contractors, or business and service partners who provide services to us, including analysis firms, vendors or business partners who may provide promotional materials to you about goods (including special offers and promotions), and others.
- Government, regulatory, or law enforcement agencies. We may disclose personal information as required by law, such as to comply with a subpoena, legal proceedings, or similar legal process including disclosure to authorized third party auditors or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate or prevent fraud, or respond to a government request, whether or not legally required.
- In connection with a merger, acquisition, or business transfer. If we sell all or a part of our company, are part of a merger, consolidation, restructuring, sale of company stock, and/or sale of assets or other corporate change, your information may be transferred as part of that transaction.
- Affiliates, Subsidiaries, Divisions. We may disclose your personal information to our affiliates, subsidiaries, and other related divisions in order to provide our Services.
- The General Public. We may disclose personal information with the general public if you choose to disclose personal information when contributing content to our Services through posting reviews about our products, forums, blogs, social features, or the like.
- Aggregate Data. We may disclose your personal information in an aggregated or non-identifying form or otherwise in a form that cannot reasonably be used to identify you.
- Collaborators and Joint Promotions. Consistent with applicable law, we may disclose personal information with collaborators with whom we jointly develop or promote our Services, including special offers, sponsorships and co-branded opportunities, and promotions.
- At Your Direction. We may disclose your information at your direction or with your consent.
- Distributors. We may share a Registered Retail Customer, Distributor or Preferred Customer's contact information with their designated Distributor. The Distributor may contact the customer to answer any questions they might have concerning the products they ordered or their AdvoCare business. These reports are provided to Distributors in strict confidence and for the sole purpose of supporting the Distributors in further developing their AdvoCare businesses. AdvoCare Distributors who receive customer information are bound by the terms of their Distributorship Agreement and the privacy and data protection covenants contained therein. AdvoCare will take reasonable measures to ensure that the information is kept in confidence.
6. Marketing Preferences
We may periodically send marketing and promotional communications and materials related to our Services by email or AdvoCare SMS. You may opt out of receiving such communications and materials from us at any time by following the instructions included in the email or for AdvoCare SMS, as described below. Please note that we may still send you certain administrative communications (e.g., changes to our Services, policies, or information about your order) to you even though you have opted out of marketing-related communications.
7. AdvoCare SMS
You may opt-in to receive timely updates and important information about AdvoCare products and events through text messages delivered to any text-enabled device through AdvoCare SMS (short message service). Once you opt-in to AdvoCare SMS, message frequency may vary. AdvoCare SMS is currently available only to subscribers in the United States. Standard text messaging and data rates may apply. You may opt-out from receiving text messages through AdvoCare SMS at any time by texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to our applicable short-code, as described in the paragraphs below, or through one of the contact options described in the “Customer Care” and the “Contact” sections in the AdvoCare Messaging Terms and Conditions. Please review our AdvoCare Messaging Terms & Conditions for more information about AdvoCare SMS.
For AdvoCare marketing communications, simply open up a new text message on your mobile phone, and in the phone number field, type in 32595. Then in the body of your text, type the term “ADVOCARE” and press send. You will receive a response communication that you have enrolled in the promotional subscription. To discontinue receiving SMS messages from AdvoCare, text "STOP" to 32595 and press send. If you are having trouble with your SMS text alert subscription, text "HELP" to 32595.
For Distributors only, simply open up a new text message on your mobile phone, and in the phone number field, type in 999333. Then in the body of your text, type the term “ADVOCARE” and press send. You will receive a response communication that you have enrolled in the promotional subscription. To discontinue receiving SMS messages from AdvoCare, text "STOP" to 999333 and press send. If you are having trouble with your SMS text alert subscription, text "HELP" to 999333.
8. Links to Third Party Websites
This Privacy Policy applies only to official AdvoCare website(s), applications, and offline methods and not to online forums of other third parties to which AdvoCare may provide links. The websites and third-party content to which we link are subject to the privacy notices or policies that appear on those third-party sites. AdvoCare has no control of sites operated and maintained by third parties, and any information you provide may be publicly accessed, read, collected and used by others who access them. If you provide any personal information through a third-party site, your interaction and your personal information will be collected by and controlled by the Privacy Policy of that third party site. We recommend that you familiarize yourself with the privacy policies and practices of any such third parties, which are not governed by this Privacy Policy. AdvoCare includes these third-party links solely as a convenience to you. The presence of a link does not imply an endorsement of the linked site, its operator, or its contents, or that AdvoCare is in any way affiliated with the linked site. The site does not incorporate any materials appearing in such linked sites by reference. AdvoCare reserves the right to terminate a link to a third-party website at any time.
9. Information Security
We take commercially reasonable steps and use administrative, technical, and physical measures designed to safeguard information in its possession against loss, theft, unauthorized use, disclosure, or modification. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure, and while we strive to protect your personal information, we cannot guarantee or warrant its complete security.
10. Your Advertising Choices
When you use our Services, our third-party advertising partners, social media providers, and analytics providers may collect personal information about your online activity on our Services and on third party websites.
These providers may use web tracking tools (e.g., cookies and web beacons, as discussed further below) to collect information regarding your online activity. In addition, our advertising partners may use this information to deliver personalized advertisements to you when you visit third party websites within their networks. Please note that you may continue to receive generic ads that are not based on your preferences.
11. Cookies and Similar Technology
AdvoCare and our partners use various tools to collect data when you visit our sites and apps, including cookies, pixels, localStorage, and other similar technologies. Some of these technologies store data in the browser or on your device. For example, a "cookie" is a small text file that can be stored on your computer's hard drive that lets AdvoCare know when and how our pages in our online properties or applications are being viewed, including to analyze trends, administer the online property, track users' movements, record how many people are utilizing the online property, and to gather information about our user base. Other technologies may use network-related or other information to recognize your device (e.g., IP address). Our Services use these technologies, for example, when you first request a web page and data is then stored on your computer or other device so the website or mobile application can access personal information when you make subsequent requests for pages from that Service. These technologies may also be used to collect and store information about your usage of the Services, such as pages you have visited, other content you viewed, and search history. Additionally, we may use these technologies to collect analytics and measure the use of our Services.
We and our partners may also use these technologies to gather personal information about how you view and use our Services and content and to connect your activity with other data we store about you. We and our partners may collect your personally identifiable information about your online activities over time and across different websites when you use the Services. The use of these technologies helps us serve you better by understanding what you are interested in, tracking trends, measuring the effectiveness of ads, saving your preferences, and storing information you may want to retrieve on a regular basis. We also allow specific, approved partners to collect data from your browser or device for advertising and measurement purposes using their own similar tools.
Your web browser can be set to allow you to control these technologies, such as whether you will accept cookies, reject cookies, or to notify you each time a cookie is sent to your browser. If your browser is set to reject cookies, websites that are cookie-enabled will not recognize you when you return to the website, and some website functionality may be lost. Depending on the make and model of your phone, you may be able to use device settings to opt out of the use of certain device IDs for targeted advertising. Some browsers permit the user to send a “Do Not Track” (“DNT”) preference to websites that the user visits indicating that the user does not wish to be tracked over time and across websites. Because there is not yet a common understanding of how to interpret DNT, we do not currently respond to the DNT signal on our websites.
12. Children
AdvoCare does not sell products and services for purchase by children. If you are under 18 years of age, you may not use the website without the involvement of a parent or guardian. AdvoCare only sells products and services to those who are 18 and older.
13. Supplemental Privacy Notice for Consumers in California, Virginia, Colorado, Connecticut, and Other U.S. States with Similar Privacy Laws
Consumers in certain U.S. states may have additional rights regarding their Personal Information. This Section provides information for consumers in California, Virginia, Colorado, Connecticut, and other states with similar privacy laws (“Relevant Laws” and “Applicable States”). Under these Relevant Laws, “Personal Data” and/or “Personal Information” generally means information that identifies, relates to, or describes a particular consumer in the Applicable States. For purposes of this Section, “Personal Information” is synonymous with “Personal Data”.
Some states define “sale” as the exchange of information for monetary consideration, while other states define “sale” as providing your information in exchange for valuable consideration, which may or may not be monetary. We do not “sell” Personal Information, as defined under California and other similar state privacy laws. However, we do engage in targeted advertising, which helps to serve you with AdvoCare ads when you are not on our site. Note that the definition of “sale” under certain state laws, such as Colorado and Connecticut, is different, and targeted advertising could be considered “selling” under such laws or “sharing” under California law.
In addition, we may process each category of Personal Information in order to protect AdvoCare’s and others’ rights, and/or to complete a merger, bankruptcy, sale of assets, or other corporate transaction, which is not included in the definition of “sale” under California or other similar state privacy laws. Please see “How We Use Your Personal Information” and “How We Disclose Your Personal Information” above for more details about our purposes for processing, including how other parties may process Personal Information.
This Section provides details about the categories of Personal Information of consumers in Applicable States that we have collected, disclosed, “shared”, “sold”, or processed for purposes of targeted advertising, as well as rights consumers have under Relevant Laws. Based on your interactions with us, we may not have collected, disclosed, “shared”, “sold”, or processed for purposes of targeted advertising each (or any) of these categories of Personal Information for each listed purpose.

Sensitive Personal Information. We do not process “sensitive” Personal Information for purposes other than as permitted by law (such as to provide you with the Services you requested or to prevent, detect, and respond to security incidents).

Purposes. We may use Personal Information and/or disclose it to third parties for the following purposes:

- personalizing, advertising, and marketing our Services;
- conducting risk and security controls and monitoring;

- quality and safety assurance measures;

Sources of Personal Information
We collect this Personal Information directly from consumers who reside in the Applicable States, as well as from social media platforms; referrals; joint marketing, co-branding, co-promotional, or advertising partners; and sources of demographic and other information, including through devices you used to interact with us through our Services, consumer data resellers, and publicly available information. The sources of Personal Information collected are noted in the “How We Collect Personal Information” and “Types of Personal Information We May Collect From You” sections above. Based on the individual’s interactions with us, we may not have collected Personal Information from each (or any) of these sources.
Consumer Rights Under California and other similar state privacy laws.
If you are a consumer who resides in California or other state with a similar privacy law, you may have the following rights, as described below.
We are required by law to verify your identity depending on the type of request in order to prevent unauthorized access of your data. Failure to verify your identity may result in your request not being processed. Where required by applicable law, we will notify you if we deny your request and the reasons we are unable to honor your request. Please note that, in some instances, we may decline to honor your request or only honor your request in part, where, for example, we are unable to verify your identity or an exception to the right applies.
Right to Know and Access: You have the right to confirm whether we are processing Personal Information about you and to request that we disclose to you the Personal Information we collected from or about you in a portable form. Depending on where you live, you may have the right to request that we disclose to you the following information:
- The specific pieces of Personal Information we collected about you;
- The categories of Personal Information we collected about you and the categories of sources;
- The business or commercial purpose for collecting, disclosing, or “selling” Personal Information about you; and
- The categories of Personal Information about you that we sold, shared, or otherwise disclosed and the categories of third parties to whom we sold, shared, or otherwise disclosed such Personal Information.
Right to Delete: You may request that we delete the Personal Information we have collected from you.
Right to Opt Out of “Sales”, “Shares”, and Targeted Advertising: Depending on the state you reside in, you may have the right to opt out of the “sale” of your data and/or the disclosure of your data for cross-context behavioral advertising/targeted advertising (known as a “share” in California). Please note that we do not sell Personal Information for monetary consideration.
Right to Correct: You have a right to request the correction of inaccurate Personal Information that we may have on file about you.
Right to Non-Discrimination: You have the right to be free from unlawful discrimination for exercising your above-listed rights under the laws of California and other states with similar privacy laws.
Right to Appeal: Depending on your state of residence, you may have the right to request an appeal if we decline to take action in response to your consumer request. If you have any concerns about the results of your appeal, you may contact your state’s Attorney General, as listed below:

To file a request in furtherance of these rights, submit your request here. Additionally, we may need to obtain information about you or your specific request in order to verify your identity and respond.
Authorized Agent
Depending on your state of residence, you may have the right to submit a request through an authorized agent. If you are an authorized agent acting on behalf of a consumer residing in California or another state with a similar privacy law, you must be able to demonstrate that you have the requisite authorization to act on behalf of the consumer. For your protection, we reserve the right to deny any request from an agent who does not submit proof that they have been authorized to act on your behalf. Because the security and privacy of your information is paramount, we will ask that you identify such persons and directly confirm that such persons are authorized to act as your agent and exercise your applicable rights under law in such situations. This may require us to contact you directly and alert you that an individual has claimed to be your agent and is attempting to access or delete your information. We will also independently verify your identity to ensure that an unauthorized person is not attempting to impersonate you and exercise your rights without authorization.
